The Ministère de l'Environnement, du Climat et de la Biodiversité - abbreviated to «MECB» - maintains this site to give the public access to up-to-date information on its activities and work.

General terms and conditions of use (GTCU) of the site

Any person making use of the information, documents, products, software and various services (collectively the "Services") offered by this site is deemed to have read and accepted all the terms and conditions of these general conditions of use.

"Organization" means the public authority, department, administration or other public body which alone or jointly with others is responsible for this site.

User obligations

Access to the site is via the Internet. Users declare that they are aware of the risks involved and accept them. They must protect themselves against the effects of computer piracy by adopting an appropriate and secure computer configuration.

The organisation cannot be held responsible for any damage that users may suffer directly or indirectly as a result of browsing this site and using its services or the websites to which it refers.

Use of the site is free of charge.

The organisation reserves the right to change, modify or suspend this site without notice for maintenance, updating or any other reason deemed necessary.

In particular, the organisation may at any time withdraw, add to, complete or specify all or part of the information and services contained or offered on the site. The organisation shall not be held liable for any direct or indirect damage arising from such modifications.

General limitations of liability

The site sometimes refers to external sites over which the organisation has no control and for which it declines all responsibility.

Unless otherwise indicated, the reproduction of other types of content (photos, videos, sound files, animations, graphics, etc.) created by the organisation itself is authorised, provided that the source is acknowledged.

Under no circumstances may this type of content be sold or rented for consideration.

Any modification, transformation or adaptation, whether total or partial, of the aforementioned types of content is prohibited.

Users who reproduce content from the portal undertake not to use it in a manner contrary to human dignity and respect for the individual.

The rights implicitly or explicitly granted to you above constitute an authorisation to use and under no circumstances a transfer of rights, ownership or otherwise.

Modification of the general terms and conditions of use

These general terms and conditions of use may be amended or supplemented at any time, without prior notice, in line with changes made to the site, changes in legislation or for any other reason deemed necessary. It is the user's responsibility to inform himself/herself of the site's general terms and conditions of use, of which only the updated version accessible online is deemed to be in force. It is possible that between two uses of the site, the specific general conditions of use may be modified, and it is therefore the responsibility of the user to read them carefully before each new use.

Applicable law and competent courts

Any dispute relating to the use of this site and its Services shall be governed by Luxembourg law and shall fall within the exclusive jurisdiction of the courts of the Grand Duchy of Luxembourg.

Data protection

The organisation processes your personal data in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC - in short «General Data Protection Regulation» or «GDPR».

Purposes and legal basis of processing

Users may contact the organisation by email at info@klima.lu. In order to respond to any questions or comments received, the organisation may need to process the user's personal data, such as their email address.

Klima.lu regularly crowns a «climate hero». To register, send an email to info@klima.lu.

The data collected on this site can only come from the voluntary registration of personal data, e.g. by contacting the organisation by email at info@klima.lu to apply to be selected as a Climate Hero.  

Categories of data processed

In addition to the e-mail address, this includes identification data and contact details for general enquiries.

In the specific case of the application to be selected as a «climate hero», two photos of the candidate will be published on the klima.lu website, together with his/her surname and first name and an explanation of why he/she has been selected.

Categories of recipients of processed data

The recipients are the organisation and Binsfeld, which technically manages the klima.lu website, and the partner Art&Wise, which manages the «climate heroes» section. Your data will not be passed on to any commercial company.

The organisation is required to comply with its obligations as a controller of personal data.

Shelf life

The organisation will keep the data collected for a period of one year and three months from receipt of said data. The personal data that forms part of the article published under the heading «climate heroes» remains accessible on the klima.lu site for as long as the klima.lu site exists, in the knowledge that climate heroes have the right to request its deletion at any time.

Rights of the persons concerned

In accordance with the RGPD, users have the right to access their data, the right to obtain a copy of it, the right to obtain the rectification of inaccurate or incomplete data, the right to object to its processing or request its deletion under the conditions set out in Article 17 of the RGPD and the right to obtain the restriction of processing under the conditions set out in Article 18.

Claims

If users consider that the processing of their data by the organisation constitutes a breach of the RGPD, they may lodge a complaint with the Luxembourg National Data Protection Commission (https://cnpd.public.lu/fr.html).
